According to the Hunton & Williams Privacy & Information Security Law Blog, Delaware's amended data breach notification law will come into effect in April of the following year. The updated law mandates that companies must notify Delaware residents within 60 days if their data has been breached. Additionally, companies will be required to notify the Delaware attorney general if the breach affects more than 500 Delaware residents. The amendments also expand the definition of "personal information" and oblige companies to provide free credit monitoring services if a breach involves a resident's Social Security number. These stricter requirements aim to enhance data protection and improve transparency for Delaware residents.
